Copyright and DMCA Policy

1. Where the material on this site comes from

Property photographs, floor plan drawings, and community descriptions belong to the communities and management companies they show. They appear here from those communities' own public marketing pages and licensed listing feeds, to help a renter compare real options. Pricing and availability figures are facts, gathered from each community's own website or feed and stamped with the date we read them.

Our own written analysis, neighborhood copy, scoring methodology, market reports, and the compiled databases behind them belong to us.

2. If you are a community or management company

You do not need a formal legal notice to have your images removed. Email help@sanmarcosapartments.com from an address at your own domain, name the community, and we will pull the images. If you would rather we show different photos, send those instead and we will use them.

3. What a DMCA notice has to contain

Under 17 U.S.C. 512(c)(3), a notice must include all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. Identification of the copyrighted work claimed to have been infringed;
3. Identification of the material claimed to be infringing, with enough detail for us to locate it — a page address and a description of the specific image is best;
4. Your address, telephone number, and email address;
5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. What we do when we get one

We remove or disable access to the material without delay, and we tell the party who supplied it, where one exists. Where the material came from a community's own marketing page, we remove our copy and stop reading that source.

5. Counter notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter notice under 17 U.S.C. 512(g)(3) containing:

1. Your physical or electronic signature;
2. Identification of the material removed and the location where it appeared before removal;
3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification;
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address, or, if outside the United States, for any district in which we may be found, and that you will accept service of process from the party who filed the notice.

On receipt we forward the counter notice to the original complainant. If they do not file an action seeking a court order within ten business days, we may restore the material.

6. False claims

Under 17 U.S.C. 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees.

7. Repeat infringers

In appropriate circumstances we terminate the accounts and cut the data sources of repeat infringers.
